Partners
Participation terms for WebMonster Partners and Recommend WebMonster
1. Operator, programmes and purpose
These terms govern participation in WebMonster Partners and Recommend WebMonster. Both programmes offer an incentive for recommending services to new customers, subject to the attribution, purchase and validation requirements in this document.
The programmes are operated by Santiago Ángel Lope del Palacio, with a business address at Calle Picasso 1, Oficina 5, 28691 Villanueva de la Cañada (Madrid), trading as WebMonster. The contact channel is the support request system in the customer area. Referred to below as WebMonster.
WebMonster Partners is for web designers, developers, agencies and other professionals who regularly recommend its services. A Partner is an individual or entity whose application has been approved, who has accepted these terms and activated participation. Partners earn commissions they can receive as payment or voluntarily convert into credit.
Recommend WebMonster is for customers with active services who occasionally recommend WebMonster to contacts or businesses. A Referring Customer is someone who activates this programme through their customer area and accepts these terms. Rewards are exclusively promotional credit, with no cash payment option.
Participant refers to both. Rules on eligible services, attribution, calculation and validation are shared. Enrolment requirements, settlement of professional commissions and promotional credit are distinguished in their respective sections.
Services purchased by Participants or their referrals are governed by the General terms and conditions and the relevant service terms. Purchasing a service does not, by itself, activate either programme.
2. Requirements, enrolment and changing programmes
2.1. Common requirements and acceptance
Participation is free. Individuals over 18 with legal capacity to contract and legally constituted entities acting through an authorised representative may participate. They must provide accurate information and keep it up to date.
Acceptance is formalised in Spanish. Before accepting, the applicant can review and correct their details. WebMonster will retain a record of the activated programme, acceptance and accepted version, and provide a retainable copy of the terms with enrolment confirmation. Subsequent corrections can be requested through a support request.
2.2. Joining WebMonster Partners
There is no requirement to purchase services, have a website, have a minimum audience or bring in a specific number of customers. Existing customers and professionals who are not yet WebMonster customers may apply.
Applicants must provide information on their identity, professional activity and planned method of recommending WebMonster. Admission is subject to manual review and approval, taking into account whether the proposed recommendations and channels comply with these terms.
Submitting an application or creating an account does not activate participation or create a right to commission. After approval, the applicant must complete the necessary details, create or link their free account and accept these terms. Enrolment takes effect when WebMonster confirms activation.
2.3. Joining Recommend WebMonster
A Referring Customer must have at least one active WebMonster service. They can activate the programme and accept its terms through the customer area without individual professional approval. No audience or minimum number of recommendations is required.
They must maintain at least one active service to register new referrals. Later termination of their services does not invalidate properly registered referrals or confirmed rewards, as set out in section 16.
2.4. One active programme
The same individual or entity cannot register new referrals in both programmes simultaneously, even with multiple accounts. Activation as a Partner replaces active participation in Recommend WebMonster.
Referrals registered before the change retain their original programme, terms and incentive type throughout their attribution and validation periods. New referrals follow the programme active when registered. Promotional rewards are not retrospectively converted into payable commissions, and changing programmes does not duplicate an incentive.
To move from Partners to Recommend WebMonster, participation in Partners must be ended and the second programme activated with its requirements met. Previous amounts and referrals will be handled under section 16.
3. Scope of participation and managing third-party services
Participants must recommend WebMonster honestly and when they believe its services suit the recipient’s needs. They are not obliged to recommend it in every case, publish favourable opinions or remain exclusive.
Neither programme grants authority to represent WebMonster, enter contracts in its name, receive payments from its customers or make commitments about prices, features or service levels.
Participation does not grant automatic access to referred customers’ accounts, data, websites or support requests. A Partner may manage clients’ services using access and permissions authorised by their owners in the control panel. Authorisation must be arranged separately, limited to permitted actions and revocable by the owner. Partners must use their authorised access and stop acting when permissions are withdrawn.
Moving a project or service between accounts requires authorisation from someone entitled to dispose of it and acceptance by the recipient. The recipient must have a compatible service and accept the relevant terms and any costs. A commercial referral does not replace these authorisations or transfer rights in content, licences or data that cannot be assigned.
Partners remain professionally independent and responsible to their clients for their own work. WebMonster does not take on that work or add development support, unlimited assistance or features beyond those purchased merely because of programme participation.
WebMonster does not guarantee income or sales volume. Each Participant chooses their recommendation methods and bears any costs voluntarily incurred, unless agreed otherwise in writing beforehand.
4. Services and customers that generate incentives
4.1. Eligible services
In both programmes, incentives are generated by base plans of WordPress Cloud Hosting (WCH), Business Cloud Hosting (BCH) and standalone Business Email, and by WebMonster Care under section 4.4. Email included in another service does not generate an additional incentive.
Other add-ons, upgrades, domains, SSL certificates, WebMonster Managed, WebMonster Pros, development and bespoke services are excluded. Hosting and email included in Managed do not generate separate incentives. Taxes are also excluded from the calculation basis.
4.2. New customers
A new customer is someone who has not previously purchased paid WebMonster services. Having a registered account without previous purchases does not prevent this status. Creating another account does not make an existing customer new.
Purchases already subject to active, documented sales negotiations with WebMonster before the Participant’s involvement will not be attributed as newly acquired customers. An old enquiry or an account without purchases alone is not enough to apply this exclusion.
4.3. First order and base-plan selection
Only the new customer’s first paid order generates a WCH, BCH or Business Email incentive. If it contains several base plans for those services, only the one with the highest monthly fee excluding tax is selected. Selection is based on the initial order and is not later replaced with another service to increase the incentive. Care is selected separately under section 4.4.
If the first paid order contains no participating plan, later purchases do not generate incentives. The exception for adding Care in a later order is governed exclusively by the next section.
4.4. WebMonster Care
Purchasing WCH or BCH in the first paid order may generate an additional incentive for one WebMonster Care subscription for a website on that hosting, even when both services are in the same order.
Care must be purchased and paid for in that first order or within 30 calendar days after payment for the first hosting order. This deadline only determines entitlement to commission or a reward: the Customer may purchase Care later, but that purchase does not generate an incentive under these programmes.
If several Care subscriptions are purchased, one will be selected from the first paid order containing Care that meets these requirements. The subscription with the highest monthly fee excluding tax is chosen; if amounts are equal, the first recorded in that order. It cannot later be replaced with another subscription to generate or increase the incentive.
Care purchases by customers who already had paid services before the recommendation do not generate incentives. Nor do additional Care subscriptions, renewals or purchases paid outside the stated period.
The Care incentive and base-plan incentive are calculated and validated separately. Cancellation, a refund, a change or non-payment affecting one does not, by itself, invalidate the other if it meets its own requirements. A Care incentive cannot be retained if that service fails to meet validation requirements, including provision on compatible hosting.
4.5. Genuine purchases and common exclusions
Purchases with no amount paid do not generate incentives. Self-referrals and fictitious transactions described in section 11 are excluded. Ordinary purchases by independent customers may qualify even if the Partner provides professional services to them, provided the other conditions are met.
5. Referral attribution
5.1. Referral link
Each Participant will receive an identifying link. Link attribution follows the last valid click within the 90 calendar days before the first paid order.
If someone uses links from different Participants, the last valid click takes precedence. Clicks after an accepted manual introduction do not displace that introduction while it remains valid, as set out in the next section.
A valid click requires a voluntary user action and legitimate attribution. Simulated clicks, hidden loads and redirects intended to assign a referral without a genuine recommendation are not valid.
Tracking is subject to cookie and privacy law and any consent required. The 90-day window does not guarantee that the browser retains the information throughout that period. Rejecting or deleting cookies, changing devices or other technical limitations may prevent automatic attribution.
Tracking information is set out in the Cookie policy.
5.2. Manual introductions
A Participant may request registration of a direct introduction before the prospective customer purchases. It must be a genuine, verifiable introduction made with that person’s knowledge and permission to share the necessary details.
The introduction is registered only when WebMonster expressly accepts it and confirms its date. A manual introduction will not be accepted if another Participant already has a valid click whose 90-calendar-day window has not expired, without prejudice to incident review under section 5.3. Lists of people or businesses cannot be reserved without an actual introduction.
An accepted introduction is valid for 180 calendar days from confirmation. During that period, it takes precedence over later clicks from other Participants. It does not displace an earlier manual introduction that remains valid or a purchase already made.
5.3. Issues and duplicate claims
The same customer acquisition can be attributed to only one Participant, under the same rules regardless of programme. It cannot simultaneously generate a Partners commission and a Recommend WebMonster reward, or incentives for several people.
The base plan and eligible Care subscription are attributed to the same Participant under the same programme. Adding Care within the period in section 4.4 does not open a new attribution or allow a later click to displace the original referrer. Attribution validity is checked for the first order; the cookie need not still be present when Care is added within that period.
If a tracking issue or dispute arises, WebMonster will review available records and submitted evidence, including customer confirmation where relevant. The Participant must report it without unjustified delay.
The absence of a cookie does not, by itself, prevent a review request, but does not guarantee manual attribution either. Evidence of an earlier recommendation may be considered without automatically displacing a valid attribution. WebMonster will communicate the outcome and reasons. System records may be corrected where an error is established.
6. Calculating commissions and rewards
6.1. Amount common to both programmes
The incentive is a one-off amount equal to three monthly fees for the selected base plan and, where applicable, three monthly fees for the selected Care subscription, excluding tax and subject to this section’s adjustments. Both are calculated independently.
In Partners, these amounts are professional commissions. In Recommend WebMonster, they determine the promotional credit reward, with no right to cash payment. Tax obligations are covered in section 8 and differences between the two credit types in section 10.
The reference is the service’s monthly rate in force when its order is placed, even if the customer purchases and pays annually. It is not calculated by dividing the annual price by twelve. For Care added later, the monthly Care rate in force for its own order applies.
6.2. Changes, discounts and amounts actually received
If the customer changes plan before validation, the lower of the initial plan’s reference monthly fee and the active plan’s monthly fee at validation will be used. An upgrade does not increase the initial maximum; a downgrade may reduce it.
Each service’s incentive will not exceed the amounts actually received and not refunded for that service at validation, excluding taxes and other items. Hosting payments will not be added to increase the Care incentive, or vice versa. Discounts or refunds may reduce the applicable amount under this cap.
If the selected service is cancelled or becomes ineligible before meeting the requirements, its incentive will not be validated. Changing from Care to Managed does not turn a pending incentive into a Managed commission. Incentives remain independent under section 4.4.
6.3. Non-recurring nature
Renewals, later purchases, add-ons and upgrades do not generate new incentives, except the Care purchase expressly permitted in section 4.4. There are no recurring commissions or rewards, lifetime payments or increases based on referral volume.
A recommendation does not change the price the customer pays. The programmes do not include coupons, referral discounts or rebates offered by the Participant.
7. Validating commissions and rewards
Partners commissions and Recommend WebMonster rewards are provisional when first recorded. Each incentive is validated when the purchase meets these terms’ requirements and the following conditions:
Monthly payment: WebMonster has successfully received the service’s first three full monthly payments. Splitting one payment into several charges, or paying adjustments and pro-rata amounts, does not count as three monthly payments.
Annual payment: 60 calendar days have passed since successful receipt of the initial annual payment, and the service remains active.
In both cases, payments must be up to date and there must be no cancellations, refunds or payment issues preventing confirmation of the purchase. A temporary technical suspension does not, by itself, invalidate the incentive.
If billing frequency changes before validation, the new frequency’s criterion applies. When moving from monthly to annual, the 60 calendar days run from successful receipt of the annual payment. When moving from annual to monthly, only full monthly periods whose service has begun and whose amounts have been received and not refunded count, together with new monthly payments meeting those requirements, until three months are complete. Future months paid in advance do not, by themselves, bring validation forward. No period is counted twice and no second incentive is generated. The change will not delay or revoke validation whose requirements were already met before it took effect. WebMonster will inform the Participant of the date and criterion applied.
WebMonster will process validation without unjustified delay once the requirements are met. Participants can view or request information about their referrals and incentive calculations and status.
These requirements apply separately to the base plan and Care. Hosting payments or duration do not bring Care validation forward: its payments or 60-day period run from its own payments. Failure to validate one does not delay the other if its requirements are already met.
A Recommend WebMonster reward is credited once validated and any applicable tax or documentation obligations are met. It does not require a payment request or follow the professional settlement schedule in section 9.
8. Documentation and tax obligations
8.1. WebMonster Partners commissions
Commissions are stated before tax. Settlement will include any legally applicable taxes and withholding.
The Partner is responsible for meeting their tax and, where applicable, employment and Social Security obligations, providing accurate, up-to-date details, and supplying any invoice or documentation legally required to settle commissions. WebMonster will meet its obligations as payer.
WebMonster will not issue invoices on the Partner’s behalf through self-billing. Where an invoice is required, the Partner must issue and send it.
If required documentation is missing or incorrect, WebMonster will request correction. The affected settlement may remain pending until it can be completed correctly, without automatic loss of the commission.
8.2. Recommend WebMonster rewards
Receiving an incentive as credit does not, by itself, make it tax-exempt or automatically make the Referring Customer a professional. Tax treatment depends on the nature of the transaction and the Participant’s actual circumstances.
The Referring Customer must supply legally required details and documentation. WebMonster will meet its reporting, tax payment on account and withholding obligations and explain any applicable tax adjustment before adding the reward. Missing required documentation may leave crediting pending after a request to remedy it, without automatic loss of entitlement.
The professional invoicing rules in section 8.1 are required only where legally applicable to the Referring Customer’s activity. The programme’s name does not change either party’s tax obligations.
9. Receiving WebMonster Partners commissions
This section applies only to Partners commissions. Recommend WebMonster does not allow bank transfer or PayPal payment requests.
There is no minimum amount for requesting payment of validated commissions.
The Partner may choose bank transfer, PayPal or voluntary conversion into WebMonster credit, providing the necessary details and documentation. Commissions are calculated and settled in euros.
WebMonster will initiate settlements between the 1st and 5th of each month. This includes requests for validated commissions for which correct documentation and payment details were received by the last day of the previous month. Requests received later move to the next cycle.
If processing falls on a non-business day for the payment method, it will be initiated on the next business day. Actual receipt depends on the payment provider.
Verification requirements and this schedule will always respect mandatory payment deadlines. WebMonster will bring a settlement forward where necessary to meet them.
The Partner must nominate a bank or PayPal account in their own name, or that of the entity they represent, capable of receiving payment. Errors in those details must be corrected before a failed transaction is retried.
The Partner bears receiving and currency conversion fees charged by their provider. Other international transfer charges will be passed on only where permitted and disclosed beforehand. Mandatory rules on allocating charges and payment-method terms will be respected. WebMonster will not add its own handling fee.
If a method is unavailable for the Partner’s country or account, WebMonster will notify them to agree another permissible option. Commission will not be converted into credit without their express choice.
10. WebMonster credit: converted commissions and promotional rewards
10.1. Voluntary conversion of Partners commissions
Conversion uses the net amount payable under the settlement documentation and applicable tax obligations. WebMonster will show the amount before the Partner confirms their choice.
Credit is added to the same holder’s WebMonster account and can pay invoices for their services. It is applied to the total outstanding amount after invoice taxes have been calculated, not as a reduction in the taxable amount.
Once confirmed and completed, conversion cannot be reversed into cash or the commission balance, or transferred to another account, except where required by law or to correct a proven error.
Credit from this conversion has no contractual expiry date and earns no interest. Leaving Partners does not remove it or change the terms of the holder’s purchased services.
Conversion records a method of settling commission and does not generate a second commission. The Partner can view transactions or request a record.
10.2. Recommend WebMonster promotional credit
Rewards are granted directly as promotional credit in the Referring Customer’s account. There is no previously payable commission or later choice between credit and cash. The amount is determined under sections 6 to 8.
Promotional credit can pay for WebMonster services purchased by the same holder. It cannot be withdrawn as cash, converted into professional commission or transferred to another account, except where required by law or to correct a proven error. It earns no interest and has no contractual expiry date.
Its application and documentation will follow the tax treatment applicable to the promotion and purchased service. The tax rule for converting professional commissions does not automatically apply to promotional credit.
Leaving the programme, moving to Partners or ending the Referring Customer’s services does not remove legitimately earned credit. Later use requires retaining or recovering an identified account for the same holder; purchasing new services is not required to preserve it.
10.3. Transactions, refunds and corrections
WebMonster will identify the origin and transactions of each credit type. Participants can view them or request a record. Promotional credit will not be combined with unpaid commission to convert it into cash.
If a service paid for with promotional credit is refunded, the portion paid with that credit will be restored as credit of the same origin; the rest will be refunded under the terms applicable to the payment made, without reducing mandatory rights. This does not generate a new reward or allow promotional credit to be cashed out.
Reversals due to error, refunds of the referred purchase or fraud are governed by section 13. Legitimate credit unrelated to the incident is not lost merely because participation is suspended or ended.
11. Recommendations, advertising and prohibited practices
Participants must clearly and understandably disclose the incentive they may receive from WebMonster, whether professional commission or promotional credit, when making programme recommendations. Disclosure must be visible in the context of the recommendation, not only on a hard-to-find legal page.
Claims about services must be truthful, up to date and must not describe experiences that did not occur. Discounts, certifications, features, guarantees or support commitments must not be invented.
The following practices are prohibited:
- Brand advertising: bidding on WebMonster, variations or misspellings, or using domains, adverts, profiles or designs that suggest the Participant is WebMonster or an official channel other than the programme.
- Coupons and manipulated recommendations: promoting the programme on coupon or cashback sites, offering rebates, publishing fake reviews or presenting paid rankings as independent without disclosure.
- Spam and unlawful customer acquisition: sending unlawful commercial communications, using unlawfully obtained data or harassing prospective customers.
- Tracking manipulation: placing cookies without a valid user action, simulating clicks, altering identifiers, artificially taking over referrals or using tools that falsify attribution.
- Self-referrals and fictitious transactions: generating incentives through purchases by the Participant, entities they control or intermediaries acting on their behalf; creating accounts, artificial reciprocal referrals or plan changes primarily intended to obtain an improper incentive. Multiple accounts must not be used to bypass the single-programme rule or per-referred-customer limits.
A family or professional relationship with the customer does not, by itself, constitute a self-referral. The assessment will consider who actually purchases and whether the transaction is independent and legitimate.
Partners must keep information about their promotional channels up to date and report material changes from those declared when applying. Personal recommendations through Recommend WebMonster must also be truthful and disclose the incentive, without requiring the Referring Customer to have a website or professional channel.
12. Brand and materials
WebMonster retains its rights in its brand, logos, mascot and materials. The programmes grant only a non-exclusive, non-transferable permission to use official materials supplied for the relevant programme, during participation and to recommend services under these terms.
Partners may use professional badges supplied by WebMonster while they retain that status. Referring Customers may share authorised referral links and materials but must not present themselves as professional Partners, representatives or official WebMonster channels.
Modifying those materials or creating badges that suggest a different official accreditation requires prior written permission. Permission does not cover registering trade marks, domains or profiles liable to be confused with WebMonster, or passing materials to third parties for other purposes.
When participation ends or the programme changes, badges and materials whose authorisation has ended must be removed. This does not prevent truthful mentions, honest reviews or brand use permitted by law.
13. Issues, checks and measures against abuse
Participants can report attribution, calculation or payment issues through a support request in the customer area. WebMonster will review complaints diligently and provide a reasoned response.
Where there are reasonable indications of fraud, impersonation or serious breach, WebMonster may provisionally suspend participation, new attributions or affected settlements while investigating. It will explain the reason and scope unless a legal obligation or protection of the investigation prevents disclosure of certain details.
Measures will be proportionate. Participants may provide explanations and evidence. Commissions or rewards unrelated to the incident will not remain blocked without a justified reason.
If a breach is confirmed, WebMonster may require removal or correction of content, cancel related commissions or rewards, and immediately end participation where severity justifies it. If conduct affects a campaign or group of referrals, cancellation may cover all commissions or rewards whose invalidity is established.
Calculation errors, duplication, refunds of the amounts underlying an incentive or proven fraud may lead to correction. If the incentive has already been paid, converted or credited, WebMonster will communicate the correction amount and reason. It may remove improperly granted credit that remains available. If already used or paid, it may request repayment of the improperly obtained amount or apply a set-off where legally permitted, respecting the right to complain and without imposing an additional penalty for that fact.
An ordinary customer cancellation or plan change after correct validation does not, by itself, allow recovery of a legitimately confirmed incentive.
14. Programme operation and liability
WebMonster will maintain reasonable means to administer the programmes and correct issues. The panel and tracking may be interrupted by maintenance or technical problems; an interruption does not remove rights that can be established by other means.
Participants must use supplied links correctly, protect their credentials and report unauthorised access or relevant incidents.
Each party is liable for breaches and damage attributable to it under the law. These terms do not exclude liabilities that cannot lawfully be limited or shift responsibility for WebMonster’s own failures to the Participant.
15. Data protection
The data controller is the operator identified in section 1.
Data is processed to manage applications, participation in both programmes, attributions, commissions, rewards, credit, payments, communications and complaints, on the basis of pre-contractual measures and performance of the relationship; to meet legal obligations; and to prevent fraud on the basis of legitimate interests, with appropriate safeguards.
Necessary providers and legally authorised authorities may access the data. It will be retained during the relationship and for applicable statutory periods. Recipients, possible international transfers and further details are set out in the Privacy policy.
Data subjects may exercise applicable rights of access, rectification, erasure, objection, restriction and portability through a support request in the customer area or the methods in the Privacy policy, and complain to the competent data protection authority, including the Spanish Data Protection Agency (AEPD).
Neither programme authorises use of referred customers’ data for other purposes. Only necessary information will be shared. Participants processing data for their own activities must have the required legal basis and provide the required information. Accepting these terms does not amount to consent to advertising unrelated to programme administration.
Information given to a Participant about a referral will be limited to what is necessary to verify attribution and the incentive. Website management or transfer between accounts requires the separate authorisations in section 3 and does not permit reuse of data for other purposes.
Where a Partner processes data on behalf of clients, they must enter into the agreements and obtain the authorisations appropriate to their role. Data hosted or processed by WebMonster on the service holder’s behalf is governed by the Data processing agreement, including where WebMonster acts as a sub-processor for an authorised professional. Adding data to an account or project requires a legal basis and compliance with the controller’s instructions.
16. Duration, leaving, changing programmes and inactivity
Participation continues indefinitely from activation while requirements are met. Participants may request to leave through a support request in the customer area. Continued promotional activity is not required to receive incentives already generated.
16.1. Leaving WebMonster Partners
Before confirming closure, WebMonster will inform the Partner of validated commissions awaiting payment, commissions awaiting validation and ongoing referrals that may still generate commission.
If amounts or referrals remain pending, the Partner may choose between:
a) Closure after settlement. Active participation ends and the Partner account enters Pending settlement status, accepting no new referrals. Previously validly registered referrals continue under their terms and attribution and validation periods. Applicable commissions will be settled through the usual procedures once the necessary documentation is supplied. Final closure is completed when all referrals are resolved and no amounts remain unsettled. During this period, the Partner is not required to keep promoting WebMonster or remain active in the programme.
b) Immediate closure with express waiver. The Partner may request closure without waiting for settlement through a voluntary, informed, specific and separate waiver of the commissions and financial rights identified in the confirmation. This will show known amounts and pending referrals whose outcome may generate commission. The waiver takes effect only to the extent legally permissible and for the rights expressly identified.
Initial acceptance of these terms is not an advance waiver of commissions. A waiver will not be presumed merely from a request to leave, inactivity or failure to respond.
If no amounts or referrals remain pending, closure can be completed directly.
16.2. Leaving Recommend WebMonster
Leaving stops acceptance of new referrals. WebMonster will explain any pending referrals and rewards, which continue under their time limits and requirements. Validated rewards will be credited to the same holder, without requiring continued recommendations or an active service to resolve those earlier referrals.
Legitimately earned promotional credit is retained under section 10. It does not become cash when participation ends. A request to leave, inactivity or failure to respond does not waive pending rewards.
When a Referring Customer no longer has active services, they cannot register new referrals until they meet that requirement again. This does not affect previous referrals or earned credit.
16.3. Termination by WebMonster and inactivity
WebMonster may end individual participation or either programme with 30 calendar days‘ notice, or a longer period required by law. Serious breaches and other grounds permitting immediate termination are exceptions.
Participation may be closed after 24 months of inactivity with 30 days’ notice, or a longer period required by law. Inactivity means neither access to or management of the programme nor new referrals, commissions or rewards during that period.
Where WebMonster decides to terminate, including for inactivity, the Participant is not treated as waiving incentives. Purchases and referrals validly registered before the effective date retain their terms and continue through the relevant periods, including the period for adding Care to an eligible referral, subject to justified cancellations under section 13.
If details or documentation needed to pay or credit an incentive are missing, WebMonster will request them and retain a record of the pending amount for the legally applicable periods. There is no contractual expiry for failing to request settlement.
16.4. Common effects and programme changes
Leaving a programme does not cancel paid services, remove the customer account by itself or cancel legitimately credited WebMonster balance. Changes between programmes follow section 2.4 and do not reduce earlier rights or allow double payment.
Closure does not prevent retention of legally required documentation. Outstanding settlement obligations, confidentiality of others’ data and legal compliance continue where applicable. No method of leaving or closure affects rights that cannot lawfully be waived.
17. Changes to the terms and application of this version
WebMonster may change these terms because of changes to services, operations, payment methods, security or legislation, or to revise the programmes’ future commercial terms.
Material changes will be notified by email at least 30 calendar days in advance, identifying their content, affected programmes and effective date. Legally required changes or urgent security changes may apply sooner where necessary, with notice of that fact.
Incentives or rights relating to referrals validly registered before the effective date will not be reduced retrospectively. Their applicable terms will be retained throughout their attribution and validation window.
Where accepting new terms is required to continue generating referrals, acceptance will be expressly requested. Not accepting may prevent new participation under those terms but does not mean losing earlier commissions, rewards or credit. Silence alone will not be used to presume a waiver of acquired rights.
Partners enrolled under version 26-1 retain the terms for their earlier referrals. This version applies to new referrals from the communicated date and once accepted. Adding Care does not retrospectively create incentives for earlier ineligible purchases, unless WebMonster expressly confirms an improvement. Recommend WebMonster requires its own activation and does not automatically apply to existing customers.
18. Communications, governing law and disputes
Communications will use the registered email and programme channels. Participants must keep these up to date. Enquiries and complaints can be submitted through a support request in the customer area.
These terms are governed by Spanish law, without excluding applicable mandatory rules, including consumer protection where relevant.
Disputes will be submitted to the courts with jurisdiction under applicable law. No waiver of legally protected jurisdiction rights is imposed.
If a clause is invalid or unenforceable, the rest remains unaffected where the contract can continue. No provision will be interpreted as excluding rights or obligations imposed by mandatory law.
VERSION: 26-2
